I went to the mall to get some glasses fixed. I placed the glasses in my pocket which though I had bought the glasses two months ago they refused to fix. I walked out of the store to the car, got in my car, and as I was about to start my car, the security guards blocked my car and came to my car and accused me of stealing a pair of glasses. I had had slight words with the store clerk for reufusing to fix the glasses I had paid $175 for two months ago for. In any event she accused me of stealing some glasses they blocked me in and I said I did not want to talk to them but they insisted I get out the car. I got out the car and got very upset and the police came and charged me with disorderly consulted and banned me from the mall. What are my legal rights? What are some attorneys that you can reccomend that are willinig to talk to me in the Metro Atlanta area. Specificaly Lithonnia Georiga. I did not steal a pair of eyeglasses so I was never charged with theft.
Unfortunately I will have to rephrase my question because I think I was misunderstood. Three months ago I purchased a pair of Guess "prescription" glasses from a chain optical store inside the mall in Lithonia, Georgia. The glasses broke. I took the glasses into the facility and they refused to fix the glasses. They had the receipt on file but stated that they only had a thirty day warranty. When I returned to my car and was about to start the car two security suv's had blocked me into the parking spot and knocked on my window and accused me of stealing some glasses. I became hysterical and upset because in my over 29 years of living I have never shoplifted or stolen anything. It is my opinion that to block me in like that is against the law. I am very concerned and disturbed at the way I was treated. I was charged with disorderly conduct and taken to jail. The store manager was told I only had "my" prescription glasses and preceded to laugh at me!
I purchased the glasses in November! The store manager was told that the only pair of glasses I had were some broken prescription purple glasses. This was a facility that makes eyeglasses. The glasses were prescription. There is no way I could have stolen them put a prescription in them and broken them in the time it took me to leave the store at the top floor of the mall close to the food court and walk to my car. These were definitely "my" glasses!


You have one problem to deal with,,,, And that is proving the
sales clerk at the Eye glass facility knew the glasses you had
in your possession were yours. If there was no alarm when
you left the store, then you have a very high probability of
forcing a unlawful detention action, A defamation of character
action. It's all based on the intent of the clerk.

Eyeglasses –Seeing from a New Perspective

As a professional life and business coach, I am always asking people to put on a new pair of eyeglasses so they can see things in a different way.   It is amazing what a difference it makes in our vision when we are wearing eyeglasses , particularly if we need to use the prescription glasses to see properly.   However, sometimes we need to choose to see things from a new and different perspective.

 

In a recent speaking presentation for a local Atlanta business association, our audience was instructed to image themselves at a buffet table.  It was early in the morning and everyone was hungry so their eyes grew wide as their stomachs roared.  Then I said, “No, this is not a buffet table full of food, but a buffet table full of eyeglasses , not just any old eyeglasses, but Elton John’s eyeglasses.  You can choose any pair you want to look through!”  Then they roared in laughter and at the thought that they could choose any eyeglasses they wanted, especially those great eyeglasses belonging to Elton John!
